GESTEL is an AI-powered image generation and editing platform. The Service allows you to generate, edit, and enhance images using artificial intelligence models.

3. User Content

You retain ownership of images you upload to the Service.
You grant GESTEL a limited license to process your images solely for the purpose of providing the Service.
You are responsible for ensuring you have the right to upload and process any images you submit.
Generated images are owned by you, subject to any applicable AI model licenses.

4. Acceptable Use

You agree not to use the Service to:

Generate illegal, harmful, or deceptive content
Infringe on the intellectual property rights of others
Generate non-consensual imagery of real individuals
Attempt to reverse-engineer or extract the underlying AI models
Overload the Service or interfere with its operation

5. Disclaimer

The Service is provided "as is" without warranties of any kind. GESTEL does not guarantee that generated images will be free of errors, artifacts, or biases inherent to AI models.

6. Limitation of Liability

To the maximum extent permitted by law, GESTEL shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

7. Changes to Terms

We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the revised terms.

9. Refund Policy

Due to the high computing costs associated with AI generation, Gestel adheres to the strict refund policy below:

General Policy: All subscription fees and credit purchases are non-refundable once any credits from the current billing cycle have been used. We do not offer prorated refunds for canceled subscriptions.
Quality Expectations: AI output is inherently unpredictable. We do not offer refunds or credit reinstatements for generations that successfully complete but do not perfectly match your subjective vision or expectations. We encourage you to use the free trial credits to evaluate the service before purchasing.
Accidental Renewals: If your subscription auto-renews accidentally, you may request a full refund within 48 hours of the charge, provided you have not used any of the newly allocated credits.
Technical Failures: If a generation completely fails to produce an output due to a technical error or system downtime on our end, the deducted credits will be automatically reinstated to your account balance.
How to Request a Refund: To request a qualifying refund, please contact us at support@gestel.studio with your account details. Approved refunds may take 5-10 business days to reflect on your original payment method.
Chargebacks and Disputes: Initiating a chargeback or dispute with your bank or credit card provider without contacting us first will result in immediate suspension or permanent termination of your Gestel account. We reserve the right to dispute any unjustified chargebacks.
Abuse of Policy: We reserve the right to refuse a refund request if we detect abuse of this policy (e.g., repeated subscribing and refunding).
