Terms of Service

This document is not yet in force. We will finalise it, with an effective date, once legal review is complete and the closed beta opens to the public.

1. The service

GESTEL is an AI design workspace for product and brand visuals, built and operated by Cho&Ahn.

This service uses generative AI to produce images and video. Results may differ from reality, and the same request can produce a different result each time. Features may change without notice.

2. Your account

You sign in with Google or Kakao. You must be 14 or older to hold an account. You are responsible for what happens under your account, and you should not share it. One person may hold one account. Do not open further accounts to collect the free credits again. We may suspend an account used to abuse the service or to generate unlawful material.

3. Rights in your content and output

You keep the copyright and ownership of what you upload and of what you generate. We do not use your material or your output in our own marketing, and we do not pass it to anyone to train AI models.

Output may be used commercially. That includes output made with free credits: it may be used freely in advertising, in sales and on product pages, and output you made stays yours to use commercially even after you cancel. You are responsible for holding the rights to the photos you upload and the products you shoot.

Having the rights to the product photos, brand material and reference images you bring is your responsibility. How far copyright subsists in AI-generated output differs between countries and is still settling, so we do not promise that copyright arises in a given result.

4. Acceptable use

Do not use GESTEL to impersonate a real person or brand, to give a misleading impression of a product, or to generate material that is unlawful or infringes someone else's rights. Automated scraping and resale of generation capacity are not permitted.

If you use an AI-generated virtual person in advertising, you must label it conspicuously as a virtual person. Korea's amended review guideline on endorsements has placed this duty on advertisers since 1 June 2026: in photo and video the label goes next to the virtual person, in text at the title or the opening. It is the advertiser's duty and we cannot discharge it for you.

5. Plans and credits

Generation draws on credits. There is one kind of credit — photos and videos are not counted separately, and what a job spends depends on the model, the size and the length, all from the same balance. The credits for each model are posted on the rate card, and a price change is announced at least 7 days ahead. The free plan's credits arrive monthly, and one person may hold one free plan. Paid plans are billed monthly or yearly, and a yearly plan gives you two months free. Credits arrive monthly either way: a yearly plan is one payment for twelve months of the ordinary monthly allowance, not a year of credits handed over at once.

Credits expire. Credits granted monthly last one month from the day they arrive; credits granted on an upgrade last until the end of the period then running. Whatever is unused expires when its time is up, and the expiry is recorded in your usage history. When you spend, the credits expiring soonest are used first. Credits spent on a generation that fails are returned to where they came from. Credits are not money and not a gift certificate. They can only be spent on generation inside GESTEL; they cannot be moved to another account, given away or sold, and we do not exchange them for cash or anything else. The withdrawal (section 7) and cancellation (section 8) rights the law gives you still apply — and what we return then is not credits but the part of what you paid that corresponds to the credits you have not spent.

Free-plan credits, credits from a promotion or event, and credits we give as an apology were received without payment, so they are not refundable, and they expire at the end of the validity we told you about. When they sit alongside paid credits, the ones expiring soonest are spent first, and only credits you paid for are counted when a refund amount is worked out.

A pass from a coupon code lets you use the paid plan the code names for the period the code sets. No card is registered; when the period ends you go back to the Free plan and nothing is charged automatically. Each code works once per account, you can hold one pass at a time, and a pass cannot be transferred to another account. A pass cannot be used while you have a paid subscription. Credits that come with a pass were received without payment, so the paragraph above applies to them, and they expire when the pass ends.

Prices in Korean won include VAT and are charged exactly as displayed at checkout, with no added fees. A yearly term is ten times the monthly price (for example Pro ₩28,000 / ₩280,000). Prices in US dollars are exclusive of any sales tax our overseas payment provider adds.

If we discontinue credits or change them in a way that reduces their value, we give 30 days' notice, and credits you still hold at that time are either converted to credits of equal value or refunded in proportion to what you paid. Credits you received without paying are compensated with credits of equal value or with service time, never converted to cash.

Credits obtained by opening several accounts to collect the free grant, by spending credits from a payment that was then cancelled or charged back, or otherwise in breach of these terms, are taken back after we tell you, and if you have already spent them we may bill you for that amount. What was taken back is recorded in your usage history.

6. Recurring payment and renewal

Paid plans charge your saved payment method automatically each month or year. To stop payments, cancel from Settings → Subscription. You can do it at any hour, without going through support.

Your next payment date and amount are always visible in Settings → Subscription. We do not send a reminder before a payment. Korea's Content User Protection Guideline recommends notifying users before each automatic charge; we do not yet send that notice, and we state it here as a term less favourable to you than the guideline.

If the price rises, or a free plan converts to a paid one, we tell you in advance and ask for your consent — 30 days ahead for either an increase or a conversion. Without your consent nothing is charged and the subscription ends.

Changing plan charges the new plan in full immediately, and the remaining days of your old plan are not prorated or refunded. Credits top up by the difference between the two plans. The exact amount is shown before you confirm.

7. Withdrawing your order

You may withdraw your order within seven days of payment. If you have not spent any credits, we refund what you paid in full.

Once you start spending credits, the portion you have used counts as digital content already supplied and cannot be withdrawn. Credits are divisible content, though, so the credits you have not spent can still be withdrawn within seven days. We tell you this in advance as Korea's e-commerce law and Content User Protection Guideline require. The amount is worked out like this: what you paid × (credits unspent ÷ credits that payment bought). When you withdraw, whatever is left of the credits from that payment is removed there and then, and the money goes back to the method you paid with within three business days of us receiving your withdrawal. We do not send it to a different account.

If output differs from how it was advertised or from what was agreed, you may withdraw within three months of receiving it, or within 30 days of finding out.

8. Cancelling, and refunds

You can cancel at any time from Settings → Subscription, in the same place and in as few steps as you signed up. Cancelling stops the next payment; you keep the plan until the end of the period you have already paid for.

If you cancel a yearly plan part-way through, we refund the unused portion of the amount you actually paid, calculated day by day, with no penalty. The time you have used is deducted from the annual amount as a daily proportion, and if you stop early we will not ask you for the difference. Annual plans are available to Korean cards, and this clause applies to them too.

Ask for a refund by cancelling and then emailing hello@gestel.studio. We pay it back to the method you paid with within three business days of receiving your withdrawal or cancellation. If you paid by card we ask the card company to reverse the charge; only when the same method cannot be used do we tell you first and refund by a method you choose. If a refund is late we add the delay compensation Korea's e-commerce law requires.

Nothing in these terms limits the rights Korean consumer law gives you, and that law prevails over this page.

9. Changes to the service and these terms

We may change or discontinue parts of the service. We give 30 days' notice of any change that disadvantages you. If we shut the service down entirely we also give 30 days' notice and refund the part of any period you have paid for but not used.

10. Liability

We work to keep the service running well. We do not promise that generated output will suit your particular purpose, so reviewing it before use is on you.

Where we cause you loss intentionally or negligently, we are liable as Korean law provides. We are not liable for loss caused by events beyond our control, or by your own fault.

11. Resolving disputes

These terms are governed by Korean law. If a dispute arises we will first try to settle it together; failing that, either of us may bring a claim in the court that Korea's Civil Procedure Act designates. You may also apply to the Korea Consumer Agency or the Fair Trade Commission for mediation.
